As everyone knows by now, a judge (appointed by a Republican) ruled that Proposition 8 in California is unconstitutional and that legislation aimed against gays and lesbians should be judged with strict scrutiny but Prop 8 supporters failed at the much lower level rational scrutiny level to advance a case.
Woohoo.
This does not mean some of my good friends and football watching buddies will be flying out to California, driving to Windsor, Ontario or taking Greyhound to Massachusetts tomorrow to marry their significant others of five to ten years, but it means that my good friends are being slightly less fucked over for the basic fact of being themselves.
Time to do a quick happy dance, even if the order is mostly likely stayed until the 9th Circuit can do its business and the Supremes can touch this in 2012 or 2013. I hope the conservatives are actually true to their logic in both Romer and Lawrence.
